Zoning Basics: Determining Uses, Floor Area, Height, and Air Rights Transfers

This course will review the basic terms and planning polices of the NYC Zoning Resolution (“ZR”). The ZR assigns zoning regulations to every property in New York City’s Five Boroughs. These regulations determine permitted uses, maximum development potential, open space, and building heights. The course will start with an overview of the ZR and then review a typical zoning map. Following this macro review, the course will conduct a micro review of the ZR’s tables, charts, and maps to demonstrate how these regulations determine the use and size of a building. We will perform sample floor area calculations of a mixed use building. Bring your calculator! Other topics such as open space, yards, and unit density will be discussed. Lastly, the process of transferring air rights (ZLDA) will be presented.

About the Speakers:
Christopher E. Wright is Partner and Zoning Counsel at the Lasser Law Group PLLC. Wright has been involved in public and private zoning and land use projects for over 20 years. Before entering private practice, Wright worked at the New York City Economic Development Corporation, the New York City Council, and the New York City Department of Education. Wright has represented and advocated for the interests of real estate entities at City Agencies including the Mayor's Office, the City Council, the City Planning Commission, the Board of Standards and Appeals, the Landmarks Commission, and the Department of Buildings. Wright has appeared before Community Boards throughout New York City and has worked with community groups in advising them as to the potential impacts of zoning changes in their neighborhoods. Wright is a member of New York City Bar Association Land Use, Planning and Zoning Committee, and the Real Estate Board of New York.
